भारतीय सेना के सेवानिवृत्त मेजर जनरल और रॉ (R&AW) के पूर्व संयुक्त सचिव वी.के. सिंह पर 'ऑफिशियल सीक्रेट्स एक्ट' (OSA) और IPC की धाराओं के तहत मामला दर्ज है। उन पर 2007 में प्रकाशित अपनी पुस्तक'इंडियाज एक्सटर्नल इंटेलिजेंस - सीक्रेट्स आफ रिसर्च एंड एनालिसिस विंग' में देश की सुरक्षा को खतरे में डालने वाले वर्गीकृत और गोपनीय दस्तावेज उजागर करने का आरोप है ।वी.के. सिंह ने CrPC की धारा 207(Section 230 BNSS )के तहत चार्जशीट में शामिल कुछ गोपनीय दस्तावेजों की प्रतियों की मांग की थी । निचली अदालत ने वकीलों की व्यक्तिगत कस्टडी की शर्त पर इसकी अनुमति दी थी, लेकिन दिल्ली हाई कोर्ट ने राष्ट्रीय सुरक्षा का हवाला देते हुए आदेश को बदल दिया और केवल अदालत में दस्तावेजों के निरीक्षण (inspection) की अनुमति दी।
सुप्रीम कोर्ट का निर्णय -
जस्टिस जे.के. माहेश्वरी और जस्टिस अतुल एस. चांदुरकर की पीठ ने हाई कोर्ट के आदेश को खारिज करते हुए कहा कि केवल OSA लागू होने से निष्पक्ष सुनवाई (Fair Trial) के लिए जरूरी दस्तावेज पाने का आरोपी का अधिकार खत्म नहीं होता ।अदालत ने राष्ट्रीय सुरक्षा और निष्पक्ष सुनवाई के बीच संतुलन बनाते हुए निर्देश दिया कि-
(1)अभियोजन पक्ष आरोपी को संबंधित दस्तावेजों की टाइप की गई प्रतियां (typed copies) दो महीने के भीतर सौंपे।
(2) आरोपी इन दस्तावेजों का उपयोग केवल अदालती कार्यवाही के लिए करेगा ।
(3) इन दस्तावेजों को इलेक्ट्रॉनिक, प्रिंट या सोशल मीडिया पर सार्वजनिक करने पर पूर्ण प्रतिबंध रहेगा, जिसके लिए आरोपी को एक महीने में अंडरटेकिंग देनी होगी ।
सुप्रीम कोर्ट ने कहा है कि किसी भी आरोपित को आरोप पत्र में शामिल दस्तावेजों को देखने या प्राप्त करने से वंचित नहीं किया जा सकता । कोर्ट ने कहा कि अगर इन दस्तावेजों को छिपाया गया, तो यह आरोपित के निष्पक्ष सुनवाई के अधिकार पर गंभीर आधात होगा, जो कि संविधान के अनुच्छेद 21 के तहत मिले है।
Retired Major General of the Indian Army and former Joint Secretary of the Research and Analysis Wing V.K. Singh, is facing prosecution under the Official Secrets Act (OSA) and provisions of the Indian Penal Code (IPC). He was accused of disclosing classified and confidential documents that could jeopardize national security in his 2007 book, “India’s External Intelligence: Secrets of Research and Analysis Wing.”V.K. Singh sought copies of certain confidential documents included in the charge sheet under Section 207 of the CrPC (Section - 230 BNSS ) . The trial court allowed access to these documents on the condition that they remain in the personal custody of his lawyers. However, the Delhi High Court, citing concerns of national security, modified the order and permitted only the inspection of the documents in court without providing copies.
Decision -
A Bench comprising Justice J.K. Maheshwari and Justice Atul S. Chandurkar set aside the High Court’s order. The Court held that the mere applicability of the Official Secrets Act does not extinguish an accused person’s right to obtain documents necessary for a fair trial.
Balancing the interests of national security and the right to a fair trial, the Court directed that-
(1)The prosecution must provide the accused with typed copies of the relevant documents within two months.
(2)The accused may use these documents only for the purposes of the judicial proceedings.
(3)The accused is strictly prohibited from making the documents public through electronic media, print media, or social media, and must submit an undertaking within one month to that effect.
The Supreme Court emphasized that an accused person cannot be denied access to or copies of documents that form part of the charge sheet. The Court observed that withholding such documents would seriously undermine the accused’s right to a fair trial, which is protected under Article 21 of the Constitution of India.
